General Terms and Conditions for (i) the sale of goods by intimnutrition.com

§ 1 Scope of Application

1. These General Terms and Conditions (“intimnutrition.com T&Cs”) govern (i) the sale of goods by intimnutrition.com.
2. All offers are directed exclusively at consumers who are interested in purchasing the goods (“Buyers”). A “consumer” is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their self-employed professional activity.
3. The validity and inclusion of any conflicting or supplementary general terms and conditions of Buyers are hereby rejected; such terms shall only become part of the contract if intimnutrition.com has expressly agreed to them in writing or in text form.
4. The language available for concluding the contract is English.

§ 2 Offer, Order and Conclusion of Purchase Contracts

1. The presentation of goods on the website does not constitute a legally binding offer by the seller. Buyers may initially place goods in the shopping cart without obligation and may correct their entries at any time before submitting a binding order by using the correction tools provided and explained during the ordering process (e.g., completeness and plausibility checks).
2. By clicking the order button, the Buyer submits a binding order for the goods contained in the shopping cart (“Order”). Registration of a user account with intimnutrition.com is not required to place an order (see § 6 below). Confirmation of the order is sent immediately after submission of the order.
3. The purchase contract for the respective goods is concluded with the seller indicated on the website (intimnutrition.com). The contract is formed by the earliest of the following events:
4. (i) an acceptance declaration by the seller sent by email,
5. (ii) delivery of the goods by the seller, or
6. (iii) execution of the payment transaction.
7. The minimum order amount is €20.00.

§ 3 General Delivery Conditions

1. Delivery of the purchased goods shall be carried out by a transport company commissioned by the respective seller to the specified delivery address within only EU Inland countries, except Hungary (no shipping to islands of EU!).
2. The delivery time is 5–15 working days, unless otherwise agreed. Shipping is free of charge for orders with an order amount of €120.00 or more; in all other cases, a flat shipping fee of €9.95 will be charged.
3. Goods will not be supplied to minors (under 18 years of age).
4. In the case of contracts concluded online, delivery is made exclusively by shipment.

§ 4 Payment Terms

1. The prices applicable at the time the Buyer submits the offer shall apply. All prices are final prices in euros, including the statutory value-added tax (VAT).
2. Buyers may generally use the following payment methods: Bank transfer
3. Costs and bank charges shall be borne by the Buyer in all purchases.
4. Unless otherwise agreed, the purchase price is due no later than placing the order.

§ 5 Refund Policy

You are entitled to a refund in the following cases:

1. If we fail to ship your order within 15 working days.
2. If we have not yet started to prepare your order (for example: if you order on Friday and request cancellation on Sunday).

§ 6 User Account

1. Use of intimnutrition.com is generally possible without creating a user account. However, users may voluntarily register as a Buyer via the designated registration forms and create a free user account. During the registration process, entries can be reviewed and corrected before submission. Upon successful registration, a contract for the use of the website (“User Agreement”) is concluded between intimnutrition.com and the Buyer.
2. User accounts may only be created by consumers. The information requested during registration must be provided completely and accurately. User accounts are non-transferable.
3. Buyers are required to keep their login credentials confidential and must notify intimnutrition.com immediately if there are any indications of unauthorized use.
4. intimnutrition.com may terminate the User Agreement at any time with 30 days’ notice in text form. Buyers may terminate the User Agreement at any time without notice by requesting deletion of their user account. Upon termination, the user account and stored data will be deleted.
5. Buyers may use the website only within the limits of its current technical availability. intimnutrition.com may temporarily restrict services where necessary due to capacity limits, server security or integrity, or technical measures such as maintenance. In doing so, intimnutrition.com will take the legitimate interests of Buyers into account.
